Marketing policy
This policy explains how ELALAN manages optional property marketing, promotions and other non-essential commercial communication in the customer account. It should be read with the Privacy notice.
Reviewing or acknowledging this policy does not itself opt you into marketing. Your actual marketing choices are controlled separately through the communication-consent settings in your account.
1. What this policy covers
Marketing includes optional messages intended to help you discover ELALAN properties, projects, offers, promotions, events, news or other opportunities that are not strictly necessary to secure your account or administer an existing transaction.
2. Service messages are different from marketing
Some messages are necessary to operate the customer account or complete your property journey and are not treated as optional marketing. These may include:
- email/phone verification, security alerts, password-reset or authentication messages;
- reservation, allocation, assignment and waitlist status messages;
- billing, payment-plan, instalment, payment-proof, clarification and confirmation messages;
- documents, statements, legally required notices and important account changes; and
- customer-service responses you requested.
Turning off marketing does not prevent ELALAN from sending those essential messages where they are necessary or legally required.
3. Marketing we may send
Depending on your choices, ELALAN may send or display:
- new or featured property opportunities and project launches;
- property discovery suggestions related to your interests;
- promotions, offers and campaign information;
- event invitations and selected company/project news;
- featured content inside the customer account; and
- follow-up communication about an optional property enquiry.
4. Channels and account preferences
The current account supports communication preferences for Email, SMS, WhatsApp Business, in-app notifications, push notifications and voice. You may also configure a preferred channel, preferred language, preferred delivery time, quiet hours, a pause-until time and a broader do-not-contact preference for optional communication.
Your account additionally supports consent decisions by communication channel and purpose/topic. This allows, for example, a customer to allow one category through email but decline it through another supported channel where the underlying communication catalogue permits that choice.
5. Consent, objections and lawful processing
Where ELALAN relies on consent for direct marketing, we will use the channel/topic choices recorded for your account. Consent must be affirmative and may be withdrawn. We do not treat silence or inactivity as consent.
Where applicable law permits another lawful basis for a limited communication activity, ELALAN will still respect your right to object to direct marketing. If you object to direct marketing, personal data will no longer be processed for that direct-marketing purpose except to the extent a minimal suppression record is required to honour your choice.
6. Personalisation and engagement information
ELALAN may use information that is relevant to your customer relationship—such as properties you have viewed or saved, your current property journey, broad location/project relevance, content interaction and communication choices—to decide which optional account content is most useful to show.
The portal currently records engagement with featured account placements, such as whether a featured item was displayed, opened or dismissed. It uses a pseudonymous browser-storage visitor identifier and an engagement session identifier for this purpose. This is described further in the Cookie policy.
ELALAN will not use optional marketing personalisation to override authoritative property availability, reservation, allocation, assignment, payment or legal records.
7. Timing, quiet hours and frequency
Your account allows preferred delivery timing and quiet hours for non-urgent communication. These preferences are intended to reduce unnecessary interruption. They may not apply to urgent security, fraud, legal or time-sensitive transaction notices where delay could affect your account or property journey.
ELALAN aims to keep marketing frequency proportionate and relevant. Repeated or excessive messages should be reported through customer support so your preferences and delivery records can be checked.
8. Communications providers
ELALAN may use authorised service providers to deliver email, SMS, WhatsApp Business, push or voice communications. We provide those providers only with the information reasonably necessary to prepare, route, deliver, secure and record the communication. Providers acting for ELALAN are expected to apply appropriate confidentiality, security and data-protection safeguards.
9. How to opt out or change your choices
You can manage optional communication from:
- Communication consent — channel/topic consent decisions; and
- Communication preferences — channel availability, marketing toggle, preferred timing, quiet hours, pause and do-not-contact settings.
You may also use an unsubscribe or opt-out mechanism included in a marketing message where available, or contact ELALAN directly. Withdrawal applies prospectively and does not affect processing that was lawful before the change.
10. Consent evidence, suppression and policy changes
ELALAN may retain records showing the communication purpose, channel, decision, time, policy/version context and related technical evidence so that we can demonstrate and respect your choices. If you opt out, we may retain a minimal suppression record so that your contact information is not accidentally re-added to the same marketing purpose.
We may update this policy when communication channels, account features or legal requirements change. A material change that affects an existing consent may require a fresh choice.
